
In a response to a Rajya Sabha question regarding the absence of an inter-cadre transfer policy in the GST department, the Ministry of Finance clarified its position. The Minister of State, Shri Pankaj Chaudhary, stated that Group B and C cadres of the Central Board of Indirect Taxes and Customs (CBIC) are managed by various Cadre Controlling Authorities (CCAs). The allocation to a specific CCA is made at the time of initial appointment, and transfers are generally limited to within that CCA’s jurisdiction.

The minister explained that the existing Recruitment Rules for these posts do not include provisions for inter-cadre transfers. However, officers, including Superintendents and women officers, do have the option to seek deputation to posts in Directorates under the CBIC across the country, provided they receive a No Objection Certificate from their respective CCA. The response concluded by stating that there is no proposal currently under consideration to introduce a new policy for inter-cadre transfers.

Will the Minister of FINANCE be pleased to state:
a. Whether there is no policy on inter-cadre transfer in the GST department, if so, the reasons for not having a policy;
b. Whether there are no avenues for Superintendents especially women officers to get their home posting despite serving for a long time in their allotted cadre; and
c. Whether Government intends to have such a policy to provide relief to its officials; if so, by when?

1. The Group B and C cadres of Central Board of Indirect Taxes and Customs (CBIC) are decentralized under jurisdiction of various Cadre Controlling Authorities (CCAs). Allocation to a CCA is made on merit-cum-preference basis at the time of initial appointment and thereafter, the officials can be transferred within the CCA's jurisdiction only. The statutory rules i.e. Recruitment Rules for the respective posts under the CBIC under the Department of Revenue, Ministry of Finance do not have any provision which allow the transfer of an officer from one cadre to another cadre. However, there are options available for officers to apply for deputation to posts outside their cadre, including to posts in Directorates under CBIC located throughout the country, subject to the 'No Objection Certificate' granted by their respective Cadre Controlling Authorities.
2. As per Recruitment Rules, the cadre of Superintendent is a Zonal cadre and these officers are required to perform their duties within the jurisdiction of the Zone. However, there are some options available for the officers working in the grade of Superintendents including women officers to get their posting/transfer in their home states. Superintendents can apply to the post of Additional Assistant Directors (AADs) in various Directorates under CBIC located throughout the country on Deputation subject to the 'No Objection Certificate' granted by their respective Cadre Controlling Authorities.
3. There is no such proposal under consideration at present.
